Modern technology puts significant stresses on our legal system which our system of English law is not really geared to address. In an English law system the evolution of law is based on precedent. Another words, to advance the legal framework a dispute is brought forward, studied and adjudicated (thus building more precedent). Generally this is a slow incremental process. The alternative is a proscriptive approach where everything is codified and amended as needed. Precedent is of much lesser value.
Modern technology is moving at light speed compared to the deliberate ploddings of our legal system. No where is this more true than the Internet and blogging. A recent blog entry on Aviva Directory gives some good legal rules for bloggers.
